1. GENERAL PROVISIONS


1.1 The SRL Beautiful Sports (“BS”, “the SRL” or “We”) is a limited liability company aiming to promote amateur sports in all its forms.


1.2 Under the GDPR, BS is the Data Controller.

1.3 We process your personal data in compliance with applicable data protection laws, including the General Data Protection Regulation No. 2016/679 of April 27, 2016 ("GDPR") and Belgian data protection laws, including the law of July 30, 2018, relating to the protection of individuals regarding the processing of personal data.


1.4 This privacy policy applies to the processing of personal data by BS when conducting our activities or when you use BS websites (the “Site(s)”) or applications developed by BS to facilitate the organization and smooth execution of races and events (the “Application(s)”). This policy explains how we collect your personal data, what we do with it, and for what purposes. It also outlines your rights and how you can exercise them.


1.5 This privacy policy applies solely to “personal data” as defined under the GDPR, excluding statistical results provided by BS in the form of aggregated and anonymized data.


"Personal data" or "personal information" means data relating to an identified or identifiable individual, whether directly or indirectly, and which (i) you provide to us, (ii) we assign to you to enable the use of our services, or (iii) is generated by your use of our services or activity on our site.


1.6 BS wishes to draw the attention of Team Leaders (as defined in Article 2) to their joint responsibility for data collection when they gather and collect registration data of team members. In this capacity, Team Leaders bear the same obligations as SIBP.


2. TO WHOM DOES THIS PRIVACY POLICY APPLY?


2.1 This Policy applies to the following categories of data subjects:

  • participants in BS events (“Participants”);
  • team leaders, captains, coaches, and sports directors of a team participating in BS events (“Team Leaders”);
  • contacts of our partners and suppliers (“Suppliers”);
  • volunteers ; 
  • visitors to our website (“Visitors”);
  • any person contacting us via our website or email address (“Interested Parties”).


3. WHAT DATA DO WE PROCESS AND FOR WHAT PURPOSES?


3.1 IF YOU ARE A PARTICIPANT OR TEAM LEADER


We process the following data for Participants and Team Leaders:

  • personal identification data (name, first name, nickname, date of birth, gender, STRAVA ID, STRAVA profile photos, country, city);
  • contact details (postal address, email, phone, emergency contact number);
  • bank details (bank account and credit card);
  • data relating to your team and your participation in our activities;
  • data concerning your activities, results, and physical performance (activity name, day and time of activity, time elapsed, speed, distance, type of activity, race time, results, segment information, course, rankings, etc., collectively the “Race and Performance Data”);
  • data regarding your physical performance and health (power, heart rate, cadence, health status, etc., collectively the “Performance Data”);
  • images (photos and videos) and sound recordings of you during our events;
  • similar information collected by a Team Leader for their team members.


This data may be collected by BS:


  • directly from the Participant;
  • through the Participant’s Team Leader;
  • through a third-party application, such as STRAVA, which collects, based on the Participant’s consent, their Race and Performance Data (“Sports Performance Application(s)”). The Participant must adjust their privacy settings on the Sports Performance Application to allow BS to access this data in line with the specified privacy settings and this privacy policy.


Video, photo, and audio recordings are also taken by private vendors in compliance with GDPR and each Participant’s image rights.


We use the aforementioned data to: ​

  1. Ensure the smooth operation of events organized by BS;
  2. Inform and promote events;
  3. Preserve the history and memory of events.


3.2 IF YOU ARE A VOLUNTEER


We process the following data: ​

  • your personal identification data (name, first name, date of birth);
  • your contact information (email, telephone);
  • data for reimbursement purposes (bank details, postal address, national registry number);


We use the aforementioned data to: ​

  1. conclude and perform the contract you have entered into or wish to enter into with us;
  2. fulfill our legal obligations.


3.3 IF YOU ARE A PARTNER OR CONTRACTING PARTY


We process the following data: ​

  • your personal identification data (name, first name); your contact information (postal address, email, telephone);
  • your contact information (postal address, email, telephone);
  • your billing information;
  • your professional data (company, position, website, etc.).


We process your data to ensure the execution of the commercial contract concluded with us.



3.5 IF YOU ARE A VISITOR OR AN INTERESTED PARTY


We process the following data: ​

  • your personal identification data (name, first name, date of birth);
  • your contact information (email, telephone);
  • the content of your message;
  • information collected via cookies in accordance with the Cookie Policy.


We process your data to:

  1. contact you when you have provided your contact information to request additional information about our services (consent);
  2. make your use of our website as efficient and comfortable as possible (statistics collection) and to protect our IT systems from attacks and other illegal activities (see the Cookie Policy).


4. ON WHAT LEGAL BASIS DO WE PROCESS YOUR DATA?


The legal bases for processing are as follows:


  • For Participants and Team Leaders: the performance of the contract arising from the Participant’s registration for an event, the legitimate interest of each Participant and BS in the smooth running of the race and/or event, and the Participant’s consent when authorizing BS to collect STRAVA Data or to capture photos, videos, and audio recordings of their participation in an event.


  • For Suppliers and Volunteers: performance of the contract.


  • For Visitors and Interested Parties: BS’s legitimate interest in the proper functioning of its website and activities within the scope of a contact request.


  • For the Press: SIBP’s legitimate interest in promoting its activities.


5. HOW LONG DO WE RETAIN YOUR DATA?


We retain your data for the duration necessary to conclude the contract, perform the contract, or maintain our contractual relationship.


We delete your personal data once the purpose for which we collected and processed it no longer exists, within the following deadlines:


  1. Data processed in connection with the performance of a (future) contract is actively retained for the duration necessary to fulfill the contract or maintain our contractual relationship and will then be archived for the legal limitation period of 10 years before final deletion upon expiration of the limitation period or any possible legal proceedings.


  1. Data of persons who have contacted us in the context of pre-contractual measures without resulting in a contract or to request additional information will be retained and deleted after 2 years if no further action has been taken by these individuals within this period.


  1. Information collected during your visit to our website will be deleted in accordance with the Cookie Policy.


6. TO WHOM MAY YOUR DATA BE TRANSFERRED?


Our personnel have access to your data strictly on a need-to-know basis and to achieve the purposes described above.


Your personal data may be transferred to our suppliers, subcontractors, and professional service providers who provide services that include data processed on our behalf. These parties may only process your personal data to perform their duties within the limits of our instructions.


When our suppliers and subcontractors are located outside the European Economic Area, BS ensures that appropriate precautions and security measures are in place to guarantee the security and confidentiality of your personal data. In particular, BS ensures the following safeguards:

  • The country to which the personal data is transferred has received an adequacy decision from the European Commission under Article 45 of the GDPR, and the transfer falls within the scope of said adequacy decision;
  • A contract containing the European Commission's standard contractual clauses for personal data protection under Article 47 of the GDPR has been concluded with the recipient of the personal data.


We may transfer your personal data to public authorities or other third parties when required by law or when necessary to protect and defend our legal interests.


Except in these instances, BS does not disclose any of your personal data, whether pseudonymized or otherwise, to third parties.


7. WHAT SECURITY MEASURES ARE IMPLEMENTED BY BS?


BS is committed to processing your data in accordance with the principle of data minimization, i.e., processing only the data necessary to achieve the purposes described above and only to the extent necessary to ensure those purposes. For example, when you consent to BS collecting your data from a Sports Performance Application, we only use this access right for the period necessary to ensure race or event rankings, considering, among other factors, daily data volume limitations. Likewise, only the data strictly necessary to achieve the described purposes will be published on BS’s Websites, Applications, and social media.


To protect your personal data from loss, destruction, and unauthorized access or manipulation, BS has implemented both technical and organizational security measures.


This means, on the one hand, that our IT system is equipped with backup, filtering, and firewall systems to protect your personal data, and on the other hand, that our staff has been trained on data breach risks and the correct handling of personal data. Access to your personal data is granted only to authorized persons in the course of their duties.


8. YOUR RIGHTS


The GDPR grants you the following rights, which you may exercise by sending an email to nfo@beautifulsports.be.


Right of Access: Where permitted by law, you have the right to ask whether we process your personal data and what personal data concerning you is processed. When you are a customer, the BS Platform’s member area largely allows access to all personal data processed by our services.


Right to Rectification: You may ask us to rectify and/or complete your inaccurate or incomplete personal data. Customers can already rectify and/or complete certain personal data in the BS Platform’s member area by updating their personal information via “your account.”





Right to Erasure: Without prejudice to the retention periods defined in Article 5, you may ask us to delete your personal data, particularly when it is no longer necessary for the purposes for which it was collected or processed, or if you have withdrawn your consent for its processing and there is no other legal basis for processing.


Right to Restrict Processing: Under certain conditions, you have the right to request limited processing, in which case your personal data may only be processed by BS with your consent, for legal claims, or for the protection of third parties' rights or significant public interest.


Right to Data Portability: If technically feasible, you have the right to ask us to transfer your personal data to another data controller.


Right to Object: You have the right to object, at any time and free of charge, to the use of your personal data for direct marketing purposes. nfo@beautifulsports.be

9. SOCIAL MEDIA AND LINKED WEBSITES


Our Sites and Applications include links to social media. They allow you to access our networks. Social media, such as Twitter, Instagram, and Facebook, may collect information about your online activity. We recommend checking each social media site’s privacy and cookie policies.


10. AMENDMENTS TO THIS POLICY


BS reserves the right to amend or modify this Policy without prior notice. BS will post any changes on this page along with the revised date. It is your responsibility to check this Policy each time you visit this website.


If we have your email address and are still processing your personal data, we will also notify you electronically of any changes to this Privacy Policy.
